These Terms and Conditions will apply every time you access our scalashapewear.com website and/or order goods from our website or view the information we provide. Please note that these Terms and Conditions also incorporate the following sections which we advise you to read. We recommend that you print a copy of these Terms and Conditions for your future reference.

All rights in this website are owned by R Paine. Any use, copying or modification is prohibited without prior permission from R Paine.

ORDERING GOODS

When you submit an order to us on our website you will receive an email confirming your order is being processed and you should check this email for accuracy and inform us of any error as soon as possible. This email does not constitute acceptance of your order by us. Your order will be accepted by us (and a contract will then be formed between us) when we despatch the goods to you. Title to the goods will pass to you on delivery.

Any promotional offers, price reductions, sale offers or any other special requirements will be automatically applied to your order and shown in your confirmation email.

Should you wish to cancel your order you should call or email us and quote the order refs number shown in your confirmation email. Any goods for return should be sent back to us in an unused condition and with their original packing. Postal cost for returning goods is at the customers expense unless the product is faulty. PROCESSING YOUR ORDER AND PAYMENT

Whilst it is our intention to keep our website up to date and error free, product descriptions or pricing errors may occur. If we discover such an error after you have placed an order with us, we will contact you prior to sending your order with the correct details. You may then either cancel your order or re-confirm it based on the correct information. If we are unable to contact you, we will treat your order as cancelled.

All prices shown on our website are inclusive of VAT. For postage costs please consult our post and packing page.

DELIVERY

Some postal addresses in Northern Ireland, some offshore islands, some remote areas of Great Britain and BFPO addresses may not be covered by our delivery charges and it may prove difficult to arrange delivery to such addresses. We will however endeavour to arrange delivery and you will be informed of these arrangements and any additional costs in your confirmation email.

Although we undertake to dispatch goods as soon as possible after receipt of your order we cannot guarantee a delivery date or time. We cannot accept liability for out of pocket expenses or other costs incurred due to failed or delayed deliveries.

All items are subject to stock availability.

Under these terms and conditions please note that should you wish to return goods you have 28 days from receipt of the goods to do so.

Should an item be found to be faulty please contact us and we will arrange an appropriate remedy.

MISSING OR LOST ITEMS

Remember, the item is not classified as ‘lost’ until it has been missing for 15 working days. For a Special Delivery™ item, the period is 10 days, for an international item, it is 30 days. After these periods you can submit a claim to us at scalashapewear.com.

GENERAL

The use of our site scalashapewear.com and any contracts formed are governed by English law.

All products are sold on the basis that they are for personal, domestic use only (unless stated other wise).

Our liability for any claim for loss or damage shall be limited to the sum paid by you for the goods and postage.

A person who is not a party to these terms and conditions shall have no right to enforce any term under the contracts (Rights of Third Parties) Act 1999.

If any provision of these terms and conditions is found to be invalid or unenforceable by a court the invalidity or un-enforceability of such provision shall not affect the other provisions of these terms and conditions.

We may assign or transfer any of our rights or sub contract any of our obligations under these terms and conditions to any third party.

You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with our specific permission in writing.

We reserve the right to change these terms and conditions from time to time and any such changes will be communicated on our website.

Where there are links on our website to third party websites which we believe may be of interest to you, we do not have any control over the content of these websites and can not be liable in respect of anything contained on them.

These terms and conditions govern the entire trading relationship between you and ourselves and will remain in force for the duration of our trading relationship.

All intellectual property rights (including use of trade marks) shall be solely owned by us. You are permitted only to use material on this website as expressly authorised by us or our licensers.

Any unauthorised use of material on this site is strictly prohibited.

We will use reasonable endeavours to verify the accuracy of any product or pricing information which we place on the website but we make no warranties (whether express or implied) in relation to the accuracy of such information.

We may terminate our trading relationship with you at any time by giving you at least seven (7) days notice. This does not affect your obligation to repay any amounts you owe to us.
